Brian represents a diverse group of domestic and international clients in admiralty and complex commercial litigation and arbitration proceedings primarily involving the construction, shipbuilding, pipeline and offshore service industries. He principally assists shipyards, rig fabrication, integration and installation contractors, as well as onshore and subsea pipeline contractors.
Brian’s litigation and arbitration experience has mainly involved the preparation and trial of construction claims concerning delay, disruption, acceleration, cumulative impacts, disputed changes orders, warranty or guarantee obligations, force majeure, breach of contract, design defects, schedule and liquidated damages, builder's risk and other insurance coverage issues. Brian’s litigation experience also includes defending offshore service contractors against various personal injury claims under the Jones Act and Longshore and Harbor Workers’ Compensation Act.
A related area of Brian's expertise involves advising clients on the many United States regulatory programs and cabotage laws impacting the import, export and transportation of merchandise, including the Jones Act (U.S. Coastwise Law), Export Administration Regulations, Harmonized Tariff Schedule and Maritime Transportation Security Act.
Brian also has experience with maritime finance matters. He recently represented a Bermudian shipping company in the back-to-back purchase and sale of an oil tanker.
